These Terms of Service ("Terms") govern your access to and use of the website located at divorcefastca.com and all related services provided by DivorceFastCA ("Company," "we," "us," or "our"). By accessing our website, creating an account, or purchasing any service, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. What We Are — and What We Are Not

DivorceFastCA is a self-help document preparation service. We prepare legal documents based on information you provide. We are not a law firm. We are not attorneys. We do not practice law.

Nothing on this website, in our documents, in our chat support, or in any communication from our staff constitutes legal advice. No attorney-client relationship is created by your use of our services.

If you have questions about your legal rights, the enforceability of any agreement, how a court may rule in your specific situation, or any other matter requiring legal judgment, you should consult a licensed California family law attorney. Every California county also offers a free Family Law Facilitator and Self-Help Center staffed by legal professionals who can assist self-represented parties at no cost.

2. Description of Services

DivorceFastCA provides the following services:

Document Preparation ($159 one-time fee): Upon completion of our online questionnaire, we generate a complete, court-ready California divorce packet containing the official Judicial Council forms applicable to your selected divorce pathway (Traditional, Joint Petition, or Summary Dissolution), along with a custom-drafted Marital Settlement Agreement where applicable. The packet is made available for immediate digital download.

Document Vault ($9.99/month subscription): Secure cloud storage for your completed divorce documents, accessible at any time from your account dashboard. The subscription renews automatically each month until cancelled.

We prepare documents based solely on the information you provide. We do not verify the accuracy of the information you submit, conduct legal research on your behalf, represent you in court, or appear on your behalf in any legal proceeding.

3. Court-Ready Guarantee

If a California court clerk rejects your documents due to a formatting or preparation error on our part, we will correct the documents at no additional charge. To request a correction under this guarantee:

  • Contact us at hello@divorcefastca.com within 30 days of the rejection
  • Provide a written explanation of the rejection reason and, if available, the clerk's written rejection notice
  • We will review the rejection and, if the error is attributable to our preparation, issue corrected documents within 5 business days

This guarantee applies to errors in document preparation only. It does not apply to rejections caused by:

  • Incorrect or incomplete information provided by you
  • Changes in court local rules after your documents were generated
  • Failure to follow the filing instructions provided
  • Documents filed in the wrong court or wrong county
  • Eligibility issues (e.g., residency requirements not met)
  • Any issue outside the scope of document formatting and preparation

4. Your Responsibilities

By using our services, you represent and warrant that:

  • All information you provide in the questionnaire is accurate, complete, and truthful to the best of your knowledge
  • You meet California's residency requirements for filing for divorce (6 months in the state, 3 months in the county)
  • You have read and understood the filing instructions provided with your packet
  • You understand that you are responsible for reviewing all documents before filing them with the court
  • You understand that filing incorrect or incomplete documents with a court may have legal consequences

You are solely responsible for the accuracy of the information you provide. DivorceFastCA is not liable for any errors in your documents that result from inaccurate or incomplete information you submitted.

5. Payment and Billing

One-Time Fee: The $159 document preparation fee is charged at the time of purchase. Payment is processed securely through our third-party payment processor.

Subscription Fee: The Document Vault subscription is $9.99 per month, billed monthly to the payment method on file. Your subscription begins on the date of purchase and renews automatically on the same date each month.

Cancellation: You may cancel your Document Vault subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. You will retain access to your documents until the end of the paid period.

6. Refund Policy

Document Preparation Fee ($159): We offer a full refund if requested before you download your completed document packet. Once the packet has been downloaded, the fee is non-refundable, as the service has been fully delivered.

Document Vault Subscription ($9.99/month): Subscription fees are non-refundable. You may cancel at any time to stop future charges.

To request a refund, email hello@divorcefastca.com with your name and order number. We respond within one business day.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIVORCEFASTCA'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

IN NO EVENT SHALL DIVORCEFASTCA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, EMOTIONAL DISTRESS, OR ANY DAMAGES ARISING FROM YOUR RELIANCE ON DOCUMENTS PREPARED BY US.

This limitation applies regardless of the theory of liability (contract, tort, negligence, or otherwise) and even if we have been advised of the possibility of such damages.

8. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT THE DOCUMENTS WE PREPARE WILL BE ACCEPTED BY ANY PARTICULAR COURT OR THAT YOUR DIVORCE WILL BE GRANTED.

9. Intellectual Property

All content on divorcefastca.com, including but not limited to text, graphics, logos, software, and the document preparation system, is the property of DivorceFastCA and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content on this site without our prior written consent.

The California Judicial Council forms included in your packet are official government forms in the public domain. Your completed, filled-in packet is your property.

10. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

11. Third-Party Services

Our website may contain links to third-party websites or integrate with third-party services (such as payment processors). We are not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is at your own risk.

12. Termination

We reserve the right to suspend or terminate your account at any time if we believe you have violated these Terms, provided false information, or used our services for any unlawful purpose. Upon termination, your right to access our services ends immediately. Sections 7, 8, 13, and 14 of these Terms survive termination.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or our services shall first be submitted to informal negotiation by contacting us at hello@divorcefastca.com. If the dispute is not resolved within 30 days, it shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in Delaware. The arbitrator's decision shall be final and binding.

You waive any right to participate in a class action lawsuit or class-wide arbitration against DivorceFastCA.

14. Changes to These Terms

We may update these Terms at any time. When we do, we will update the "Last Updated" date at the top of this page. If the changes are material, we will notify you by email or by a notice on our website. Your continued use of our services after the effective date of any changes constitutes your acceptance of the updated Terms.
